Legacy Awarded Best Condo of 2018

  1. Legacy Internet:
  2. Bill spoke to an internet individual who advised his thoughts were we place additional antennas up to enhance the internet service. The board and unit members (questioned last meeting) believe no additional funds should be spent on the internet. Each unit should provide it the internet service to unit.
  3. Board will look into special pricing at group rates.

 

  1. Water Leaks
  1. September storm brought water leaks into units 205, 201, and 203. PMC advised many condos contacted them with leaks for the first time from serval different condos.
  2. The siding was removed on all floors wood was replaced where the wall meets the floor. Water proofing was sprayed from the floor up the wall approximately 18 inches.
  3. Unit 203 removed the entire inside wall so signs of water leakage was seen the source was unknown. Cracks were filled on the roof near the leak area. PMC believes the source of the leak may be the roof.
  4. Confirmed leaks in unit 203 and 103.
  5. A leak in unit 205 is still being monitored the board has no other leaks reported.

 

  1. Comcast Cable –  Same as last meeting not completed
    1. Unit Owners are allowed to open a sub account with Comcast.
    2. If an owner opens an account please remember the boxes in the unit, one belongs to the Legacy and the others are your responsibility to return.
    3. Board going to check units with owners to update the association cable box list.
    4. Discussion of returning boxes to Comcast and have owner get their own box.
    5. Comcast running a Wi-Fi special some owners have taken advantage of this. You may turn off the account over winter.

 

  1. Current Legacy Projects- 2019
    1. Roof completion 2018-2019 – $74,082.00 – Stell Exteriors Inc.
    2. Due to cold weather moving in quickly last year the roof project was delayed to the spring.
    3. Walkway and Pool deck to be re-coated 2019
  1. Ferguson will notify when project will begin we are trying to wait until after the completion of the roof.
  2. Note that walk ways will be closed off for several days during this process.
  • AN estimate was reviewed to extended the deck coating to include the area which is currently carpeted on the 1st, 2nd, and 3rd floor. Ferguson estimate was $11,876.00
    1. Stairs replacement
  1. The board will be meeting with the contractors to ask questions and see the step styles.
  2. Walch Welding 180,000 for both stairs
  • Bill Swenson and sons – Fabricate new stringers and ¼” diamond plate stair treads to match existing stair wells *only difference between new and old is attachment point at top of each rise.$ 91,083

 

First Floor Storage area:  

    1. Dominic looking at other options for storage area such as cabinets. Owners are being asked for ideas for the space as well.

 

  1. The board may be looking at a 2020 special assessment which will depend on the cost of the stair replacement.

 

  1. Video Cameras are now on line showing live time on internet
    1. 2 additional cameras will be added to the system one at the pool area and another at the far stairway in the garage area. A new DVR was purchase with a 3 year warranty. The cost
    2. A new password and logo on will be created.

  4. Storm Doors: With the changing of models by storm door companies the board as decide the standard door will be the style as on unit 301, 303, 305, and 306.
  5. Reminder Bikes require bike tags – Contact Property Management for tags
  6. Make sure PMC has the proper key to make entry into the unit
  7. Owners MAY NOT change windows or doors without approval from Legacy Board. The request must be a written request addressed to the board and Jeannie Benson @ PMC.  Board approval will also be a written response.  ANY OWNER FAILING to abide by the by-laws will be responsible to return the item to its original condition and fined by the board.
  8. The board discussed Owners are responsible for all problems or conditions inside there unit. If an Owner believes their problem stems from an Association related issue it is the responsibility of the owner to get documentation showing it is an Association issue.  If the Association obtains a contractor or orders an evaluation and the remedy is owner related the cost will be passed on to the owner.
  9. The condominium is our home. We can all save cost by helping out when noticing something needs to be done.

  1. Pool – Good possibility Paula will be returning
  1. The 2019 Season the pool will be open weekends from Memorial Day until June 17, 2019 when it will open full time.
  2. Pool will close after Labor Day weekend.
  3. No owner is to open the pool area without consent from PMC and the Legacy Board.

 

  1. New Business:
    1.  Law Passed – TAXES IMPOSED ON CHARGES FOR THE RENTAL OF TRANSIENT ACCOMMODATIONS.
  1. As of October 1, 2018, a new law imposes Sales Tax, the State Occupancy Fee, and the Meadowlands Regional Hotel Use Assessment on charges associated with the rental of transient accommodations. The law also authorizes certain municipalities to amend or adopt an ordinance to impose the following taxes on charges for transient accommodations: the Municipal Occupancy Tax, Sports and Entertainment Facility Tax – Millville, Atlantic City Luxury Tax, the Atlantic City Promotion Fee, Cape May County Tourism Tax and Assessment, and the Hotel Occupancy Tax – Elizabeth, Newark, and Jersey City (contact the municipality directly for information on the Hotel Occupancy Tax).

Furnished or unfurnished private residential property, including but not limited to condominiums, bungalows, single-family homes, and similar living units, where no maid service, room service, linen-changing service, or other common hotel services are made available by the lessor, and where the keys to the property, whether a physical key, access to a keyless locking mechanism, or other means of physical entrance to the property, are provided to the lessee at the location of an offsite real estate broker licensed by the New Jersey Real Estate Commission pursuant to N.J.S.A. 45:15-1 et seq

 

  1. Every person who charges for the rental of a transient accommodation is a seller and must register with the State for the collection and remittance of all applicable taxes, fees, or assessments by filing a business registration application (Form NJ-REG) at least 15 business days prior to the first rental occurring on and after October 1, 2018, but no sooner than September 20, 2018,

 

  1. Example: Customer rents a vacation home from September 28, 2018 to October 4, 2018, for $2,100.00. Since part of the rental takes place after October 1, 2018, Sales Tax and the State Occupancy Fee must be collected based on the number of days falling in the taxable period ($2,100.00/7 = $300.00 x 4 days = $1,200.00)*. The invoice, bill, or other receipt issued to Customer states:

Weekly Rental            $2,100.00

Sales Tax ($1,200.00* x 6.625%)       79.50

State Occupancy Fee ($1,200.00* x 5%)       60.00

Total    $2,239.50.

 

Legacy board is passing on this information to the owners and is in no means advising owners how to handle this new law. The board advises each owner who rents their unit speak with their personal attorney or tax advisor.

 

 

  1. A recent law change was imposed stating condos now must have the 10 year smoke detectors installed instead of the 9 volt battery style. The State monitors the smoke detector in the hall way which is hooked up to the electrical system.  

 

  1. A review of a Legacy construction policy is being considered.

 

  1. Legacy Snow Removal

 

  1. Over the winter a unit owner complained of snow being on the walkway area and demanded it be removed. The owner(s) advised they were unable to remove the snow. The commend was documented “this was a liability issue”
  2. The board and owners have discussed in serval meetings in the past during the winter season owners would shovel the snow if they were at the legacy during a storm or after a snow storm to their unit.
  3. Since the owner used the wording of “Liability” the Legacy Board is now on notice and liable in the case of snow removal.
  4. The board is going to try and off set with funds from internet savings. and a budget for snow removal will be created. PMC was advised to clear the walk ways and stairs after every snow event.
  5. To note PMC advised they were doing no snow removal at other condos with the rising temperatures and sun. Charges for last year’s snow removal were $245. The increase will be re-reviewed next year depending on the removal cost.

 

 

 

 

 

  1. Fence replacement
    1. The board is looking at replacing the fence near the dumpster area. High winds knocked down one portion of the fence in April 2019.

 

  1. Owners are reminded if you see something wrong please bring it to someone’s attention. If you see something minor such as weeding, lite clean up or other small issues it saves the association and you on rising cost.

RULES AND REGULATIONS OF

LEGACY INN AT PLYMOUTH, A CONDOMINIUM

 

  1. The walkways, entrances, corridors, stairways and driveways, shall not be obstructed or used for any other purpose than for ingress to and egress from the buildings.

 

  1. No exterior of any Unit shall be decorated or modified by any owner, occupant, tenant or guest in any manner without prior written consent of the Board of Directors of the Association.

 

  1. No bicycles, scooters, baby carriages or similar vehicles or toys or other personal articles shall be allowed to stand unattended in any part of the Common Elements.

 

  1. No owner, occupant, tenant or guest shall make or permit any noises that will unreasonably disturb or annoy the occupants of any of the other units, or do or permit anything to be done which will unreasonably interfere with the rights, comfort or convenience of the other owners.

 

  1. Each owner shall keep his unit in a good state of preservation and cleanliness and shall not shake, sweep or throw, or permit to be shaken, swept or thrown there from, or from the doors and windows thereof, any dirt or other substance.  No towels, laundry, or other clothing shall be hung or draped in or out of any window or over any railing or stairway, or otherwise outside any unit upon the condominium property.

 

  1. No sign, notice, advertisement, flag, banner or the like shall be inscribed or exposed on or at any window or other part of the exterior of the building, nor shall anything be projected out of any window in the units without approval of the Board of Directors.

 

  1. All refuse and garbage shall be disposed of in the facilities provided by the Association for such purpose and only in the manner as the Board of Directors may direct.  Burning of trash or refuse is prohibited.

 

  1. No radio or television aerial shall be attached to or hung from the exterior of any unit without prior approval of the Board of Directors.

 

  1. Any agent of the Board of Directors or managing agent and any contractor or workman authorized by the Board of Directors or such managing agent may enter any unit or storage area at any reasonable hour of the day for the purpose permitted under the terms of the Master Deed or By-Laws provided however, that except in the case of emergency, entry will be made by prearrangement with the owner, occupant, tenant or guest.

 

  1. The Board of Directors may retain a pass key to each unit.  No owner shall alter any lock or install a new lock on any door leading into his unit or quarter unit

without providing a key to such lock or the means to open same to the Board of Directors for its own use.

 

  1. Vehicles shall be parked only in designated areas as determined by the Board of Directors of the Association and in a manner which will not impede or prevent access by others, and the owners, their employees, servants, agent, visitors, licensees and families will obey any traffic regulations promulgated in the future for the safety, comfort and convenience of the owners.  No vehicle that does not operate under its own power shall be left on the condominium property more than 24 hours; parking of trailers is not permitted and there shall be no vehicle repair work done on the condominium property.

 

  1. All units of a maximum capacity of 6 persons.

 

  1. No Grilling using gas or charcoal on the Legacy Property including balconies and pool area.  This is an Ocean City Law as well as a State Law.

 

  1. Please throw trash away in dumpsters behind the Legacy Office
